2007-Gonzales v. Carhart

Congress issued a Partial-Birth Abortion Ban Act, in 2003, which was then challenged in court by Dr. Leroy Carhart. Dr. Leroy Carhart performed late-term abortions and emphasized the “undue burden” on the right to abortion. The Act was ruled unconstitutional on multiple counts within District Courts where the government then appealed to the Court of Appeals for the Eighth Circuit. The case was upheld and the decision was a 5-4 vote that the ban on partial-birth abortions was “not unconstitutionally vague”(“Gonzales”) and does not place an undue burden on women’s access to abortion.
